Welcome to Vortexa Cloud. These Terms of Service ("Terms") govern your access to and use of our virtual server provisioning, container hosting, API access, and related cloud services (collectively, the "Services"). By registering an account or provisioning any resource on the Vortexa network, you represent that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately terminate all active containers and deactivate your account.
2. Service Provisioning & Acceptable Use
Our virtual containers, bare-metal server allocations, and network bandwidth are provided strictly for lawful application hosting, game server virtualization, and developer API operations.
Prohibited activities include but are not limited to:
• Executing malicious scripts, denial-of-service (DDoS) tools, or network scanning software.
• Mining cryptocurrency or running unapproved resource-intensive background loops on shared tiers.
• Hosting or transmitting illegal content, malware, or unlicensed software.
• Bypassing resource container constraints or attempting unauthorized access to host hypervisors.
3. Free Tier Resource Policy
Vortexa Cloud provides a Free Compute Tier to support open-source development and trial deployments. To maintain resource efficiency on our server nodes, we enforce strict activity constraints:
• Free instances require activity (either console login, container reboot, or web traffic) at least once every 7 days.
• Inactive instances are automatically flagged and placed into suspended status.
• After 7 consecutive days in suspended status, the instance and all associated persistent storage volumes will be permanently deleted and cannot be recovered.
4.1. Vortexa offers both free and paid hosting services. Free accounts are subject to certain limitations as specified on our website.
4.2. For paid accounts, you agree to pay all fees and charges associated with the selected hosting plan. Payment details, including billing cycle and payment methods, will be outlined during the account setup process.
4.3. Indian Consumer Law Notice – Digital Services: Under the Consumer Protection Act, 2019 (India) and the Information Technology Act, 2000, consumers purchasing digital services are entitled to certain protections. However, where a digital service has been activated and performance has commenced at the consumer's express request, the right to a refund solely on the grounds of change of mind may not apply. By activating or using our services immediately after purchase, you expressly request early commencement of the service and acknowledge that refunds outside the windows described below are subject to the conditions set out in this section. Nothing in this clause limits any non-excludable statutory right you may have under applicable Indian law.
4.4. 48‑hour unconditional refund: Within 48 hours of initial purchase or account activation, you may request a full refund for any reason (excluding non‑recoverable transaction fees). No justification is required during this period.
4.5. 14‑day limited refund window: Beyond the initial 48‑hour period and up to 14 days from purchase, refunds are available only where you experience a persistent service fault attributable to Vortexa's infrastructure (for example, sustained platform outages or network failures that prevent reasonable use of the service) and we are unable to remedy the issue within a reasonable time.
4.6. Exclusions (applies to 14‑day period only): After the 48‑hour unconditional period, refunds are not available for (i) issues caused by user configuration, code, workload, or third‑party dependencies; (ii) violations of these Terms, Fair Use, or Acceptable Use; (iii) scheduled maintenance, emergency maintenance, or external upstream incidents; (iv) non‑refundable add‑ons or pass‑through fees (e.g., payment processor charges, domain costs); or (v) services already canceled by the user.
4.7. How to request: For all refund requests, email us at admin@vortexa.cloud with your account details and reason for the request. For 14‑day refunds, please include logs or details showing the infrastructure fault (timestamps, affected services, steps to reproduce). We may request reasonable cooperation to investigate and remediate before issuing a decision.
4.8. Calculation: Approved refunds are issued to the original payment method where possible and may be prorated and/or net of non‑recoverable fees (e.g., processor fees, promotional discounts). Processing times may vary by provider.
4.9. Abuse & compliance: We may decline or revoke refunds for misuse, fraudulent activity, excessive chargebacks, or breach of these Terms. Nothing in this section limits statutory rights that cannot be excluded under applicable Indian law, including rights available under the Consumer Protection Act, 2019.
5. Content and Intellectual Property
5.1. You agree not to host or transmit any content that is illegal, infringing, obscene, defamatory, or violates the rights of any third party.
5.2. Vortexa reserves the right to remove or suspend any content that violates these terms or infringes upon the rights of others.
5.3. Vortexa retains the right to review and assess any content hosted or transmitted on its platform if deemed suspicious or potentially violating these terms. In such cases, Vortexa may, at its discretion, conduct a thorough examination of the content to ensure compliance with the stipulated guidelines. This includes but is not limited to investigating potential illegal activities, infringement issues, obscenity, or defamation concerns.
5.4. Users agree to cooperate with any review initiated by Vortexa and provide necessary information or clarification regarding the content in question. Failure to cooperate may result in the removal or suspension of the content in question without further notice.
5.5. Vortexa reserves the right to take appropriate actions, including the removal or suspension of content, based on the outcome of the review process, to maintain the integrity of its platform and uphold the rights of third parties.
6. Data Preservation & Liability Limit
While Vortexa implements enterprise-grade storage hardware and redundant arrays, you acknowledge and agree that:
• Customers bear sole responsibility for configuring, maintaining, and verifying their own off-site data backups.
• Vortexa Cloud provides no warranty regarding data persistence or container uptime.
• In no event shall Vortexa Cloud or its parent entity be liable for any lost profits, corrupted databases, game server downtime, or incidental damages arising from service interruptions.
7. Governing Jurisdiction
These Terms and all disputes arising from your use of the Vortexa Cloud platform shall be governed by, and construed in accordance with, the laws of India, without regard to conflict of law principles. Any legal actions or proceedings must be initiated in the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.
